TNC TERMS AND CONDITIONS
Theia New Consultancy LLP herein after referred as “TNC” hereby publishes terms and conditions in accordance with Privacy Policy for maintaining Privacy of Information shared to us for availing various Services offered by our Platform.
TNC may have different users for the Platform and hence hereinafter referred them as “Customers” while professionals receiving the Services like Doctors/Medical Professional, Statutory Agencies, Government Bodies, Professional etc. herein after referred as “Beneficiaries”
- During the course of interaction using our platform, we may collect relevant information needed by our system to give maximum efficiency of our service. This information may be classified as personal information under the purview of Regulation 4 of the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011. Please go through these Terms & Conditions and the Privacy Policy available at www.theianew.com carefully before you decide to avail the services from TNC on this platform. These Terms & Conditions and the Privacy Policy together constitute a legal agreement between you and TNC in connection with your visit to the Website and use of the Services.
- Services offered by TNC may change from time to time done under the sole discretion of TNC and the Agreement will apply to every user of our Platform. Your continued use of the Platform is conditioned upon your compliance with the Terms of Service, including but not limited to compliance with the Terms of Service even after alterations, if any. At any point, if the user doesn’t agree with our policy/terms and conditions, they can discontinue the said Platform.
- The Agreement is published in compliance of, and is governed by the provisions of Indian law, including but not limited to: The Indian Contract Act, 1872, The (Indian) Information Technology Act, 2000, and The rules, regulations, guidelines and clarifications framed there under, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”), and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (the “IG Rules”).
- Age is not a criterion for using TNC’s Services, or visit or use the Platform in any manner. By registering, visiting and using the Platform or accepting this Agreement, you represent and warrant to TNC that you have the right, authority and capacity to use the Platform and the Services available through the Website, and agree to and abide by this Agreement.
- Beneficiaries and Customers will use the Platform to meet and interact with one another for their transactions. Neither the Beneficiaries nor TNC takes any liability arising from these services. We reiterate TNC is facilitating comfort for availing a particular Service as mentioned/published on our Platform.
- The terms “Personal Information” and “sensitive personal data or information” are defined under the SPI Rules, and are reproduced in the Privacy Policy. TNC shall not be accountable in any manner for the legitimacy of the personal information or sensitive personal data or information supplied by the Customer to TNC or to any other person acting on behalf of TNC.
- Beneficiaries and Customers are required to secure their user id and password at all times. In the event of loss of the same, proper procedure needs to be applied for its retrieval. TNC will not be liable for your losses caused by any unauthorized use of your account. You may be liable for the losses of TNC or other parties as the case may be, due to any unauthorized use of your account.
- TNC will collect, directly or indirectly, and display on the Platform, pertinent information regarding the profile and practice of the Beneficiaries listed on the Platform, such as their specialization, qualification, fees, location, visiting hours, and similar details. TNC takes reasonable efforts to ensure that such information is updated at frequent intervals. Although TNC screens and vets the information, it cannot be held accountable for any inaccuracies or incompleteness represented from it, despite such reasonable efforts.
- Services provided by TNC or any of its licensors or service providers are provided on an “as is/available’ basis, and without any contracts or conditions (expressed or implied, including the implied warranties of merchantability, precision, fitness for a particular purpose, title and non-infringement, arising by statute or otherwise in law or from a course of dealing or usage or trade). TNC does not provide or make any depiction, warranty or guarantee, expressed or implied about the Platform or the Services. As fully permitted by law, TNC disowns all liability arising out of the User’s use or dependence upon the Platform, the Services, representations and warranties made by other Users, the content or information provided by the Users on the Platform, or any opinion or suggestion given or expressed by TNC or any User in relation to any User or services provided by such User.
- TNC’s Platform may be linked to the website of third/external parties, affiliates and business partners. TNC has no control over, and is not liable or accountable for content, exactness, validity, consistency, quality of such websites or made available by/through our Website. Inclusion of any link on the Website does not imply that TNC approves the linked site. User may use the links and these services at User’s own risk.
- If TNC determines that you have provided fake, inaccurate, or partial information, including through feedback, TNC reserves the right to immediately suspend your access to the Platform or any of your accounts with TNC and makes such declaration on the Platform alongside your account as determined by TNC for the protection of its business and in the interests of Users. You shall be liable to indemnify TNC for any losses sustained as a result of your misrepresentations or fraudulent feedback that has unfavourably affected TNC or its Users.
- TNC enables Users to connect with Beneficiaries through two methods: a) Book facility that allows Users book an appointment through the Website/mobile app b) Telephonic Call booking TNC will ensure Customers are provided confirmed appointment on the Book facility. However, TNC has no liability if such an appointment is later cancelled by the Beneficiaries.
- Cancellation and Refunds: Customer is entitled for refund and cancellation of payments received for the service only if the Beneficiaries approves the same. All refunds duly approved should be submitted within 15 days of the services requested.
- Copyright: Any content, information or part thereof displayed in our Platform or website is sole property of TNC and no one is permitted to use/republish (including portion) of the same without written permission from TNC. Parties trying to do so will be liable for penal action as per the law of land.
- Disputes: Customer and Beneficiary agree that this agreement and contractual obligation mentioned in the Policy will be governed by the law of the land (in this case, various applicable laws in India). Disputes arising out of this agreement/services shall be dealt in accordance with Arbitration & Conciliation Act 1996 Seat of Arbitration shall be in Mumbai and the arbitration shall be conducted in English by sole Arbitrator appointed by TNC. The said Court shall have exclusive jurisdiction over the dispute arising out of this agreement/service.
- Terms: When you use TNC’s Platform for any Services, it is deemed that you have accepted and agreed to be bound by this Agreement, the Privacy Policy, Terms and Conditions applicable to any Service that is provided by this Platform. The use of this Application by You is administered by this policy and any policy so mentioned by terms of reference.
